Terms of Use - KAT International Wellness

These Terms of Use govern your access to and use of the Kat International Wellness website and mobile app (“Platform’s”). By accessing or using the Platform’s, you agree to comply with these Terms. If you do not agree, please refrain from using the Platform’s.

1. Wellness Programs & Services

Kat International Wellness provides custom and general wellness programs and resources related to overall wellness, hormonal balance, and overall lifestyle enhancement. The Platform’s content is intended for applied informational purposes only and is not a substitute for medical advice/diagnosis. You should consult with a licensed healthcare provider before beginning any fitness or wellness program.

2. Not Medical Advice

The content on this Platform’s, including but not limited to articles, videos, testimonials, and program plans, is intended to provide custom and/or general wellness information. Kat International Wellness is not a medical provider, and we do not diagnose or treat medical conditions. Always consult a licensed healthcare provider before making changes to your diet, exercise, or wellness routine.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into a contract to use the Platform’s and the services offered. By using the Platform’s, you confirm that you meet these eligibility requirements.

4. Fees & Payment Terms

The Platform’s offers both free and paid services. If you choose to purchase a subscription or access a paid service, you will be charged the applicable fees, which are detailed upon request.

Payments are processed through a third-party payment processor, and you agree to use valid payment methods (credit/debit cards or other authorized payment methods). Fees are charged one time or on a recurring monthly basis, and in those instances, you agree to pay the fees until you cancel your subscription. You are responsible for all applicable taxes associated with your purchase.

All fees are non-refundable except as expressly stated in our cancellation policy below.

5. User Content

Users may upload, share, or post content on the Platform’s, including photos, testimonials, or comments (“User Content”). You retain ownership of your User Content but grant us a non-exclusive, royalty-free license to use, modify, and display your User Content on the Platform’s for marketing and promotional purposes.

You are solely responsible for your User Content, and we assume no liability for any content that violates third-party rights or applicable laws.

6. No Liability for Health-Related Issues

You understand and acknowledge that using the Platform’s services, including fitness advice, nutrition plans, supplements and vitamins, and wellness programs, may involve physical activity. You agree to use the Platform’s at your own risk. Kat International Wellness, its employees, and its CEO Kat Ostroumova are not liable for any health-related injuries, issues, or adverse effects resulting from the use of the Platform’s or its services. By using the Platform, you waive all liability claims against us.

7. Indemnification

You agree to indemnify, defend, and hold harmless Kat International Wellness, its affiliates, employees, contractors, and CEO Kat Ostroumova from and against any claims, damages, losses, liabilities, and expenses (including attorney’s fees) arising from your use of the Platform’s, your User Content, or any violation of these Terms.

8. Violation of Terms

If we determine, at our sole discretion, that you have violated these Terms, we may take one or more of the following actions:

  • Send you a formal warning.
  • Temporarily suspend your user account.
  • Delete your user account.
  • Temporarily or permanently block your access to the Platform’s.
  • Report your conduct to appropriate authorities.
  • Initiate legal action against you.

9. Cancellation & Refund Policy

Free Trial: You may cancel your subscription during the 7-day free trial period without incurring any charges. After the trial period ends, you will be charged according to the selected plan.

Non-Refundable: All payments are non-refundable once processed. If you are charged after the 7-day trial, you are solely responsible for the payment. Additional Non-Refundable Terms include but are not limited to:

  • General App-based programs
  • Customized or personalized programs
  • Meal plans or nutritional guidance services
  • Merchandise and/or accessories (bands, water bottles, clothing, etc.)
  • Subscription-based services
  • Any portion or installment of a payment plan, regardless of usage or program completion

Payment Plans: Clients who opt for a payment plan are required to adhere to the agreed-upon schedule. This includes:

  • Making each payment in full and on time, according to the pre-established billing cycle
  • Ensuring that payments are completed prior to accessing the next portion or instalment of the program
  • Failure to meet payment deadlines may result in immediate suspension or discontinuation of access to the program, without refund or credit

To cancel: Clients may cancel program at any time and must complete cancellation form prior to canceling any program. Visit the "Manage Subscription" section in the app. Please speak with an official representative (CEO or CFO) to ensure cancellation is confirmed.

10. Disclaimers

  • No Warranties: The Platform’s and its content are provided “as is,” without any warranties or representations, express or implied.
  • Health Disclaimer: The content provided is for educational and informational purposes only. Always consult with a healthcare professional before making changes to your wellness routine.

11. Governing Law

These Terms of Use are governed by the laws of the Province of Ontario, Canada. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in Toronto, Ontario.

12. Changes to Terms

We may revise these Terms of Use at any time. Updates will be posted on this page. By continuing to use the Platform’s after any updates, you agree to the revised Terms.
